In 2009 the ABA created the Commission on Ethics 20/20 to consider changes to the Model Rules in light of changes in technology and the globalization of the provision of legal services. The Ethics 20/20 Commission did a lot of considering, but not a lot of changing. It proposed two packages of rule amendments, one of which was adopted in August 2012 and the second in February of 2013. This CLE provides an overview of the 20/20 Commission’s process, the issues it considered, and the amendments to the Model Rules that passed the House of Delegates. It will also consider some of the issues avoided by the ABA and what they reveal about the current state of the law governing lawyers. (Professor Wendel was involved as a Reporter to one of the working groups created by the 20/20 Commission.)
