"High Above Cayuga’s Waters? Providing Legal Assistance to the Cannabis Industry"
The recreational and medical cannabis industry is growing rapidly in many states, including our neighboring states of Massachusetts and Vermont, and the General Assembly may reconsider legalizing cannabis for recreational use in New York. Growers, dispensaries, lenders, and other commercial enterprises need legal assistance just like any other legitimate business. However, the possession, growing, and distribution of marijuana remains a crime under federal law. This CLE explores the complex ethical issues presented by this legal gray area, including the interpretation by state bar associations nationwide of prohibitions on counseling or assisting clients in violating the law. Even for lawyers who do not intend to represent clients in this industry, the application of rules against assisting client crimes to cannabis clients provides an interesting case study of ethics rules in action.
